Abstract

ABSTRAKPenelitian ini menggunakan pendekatan kualitatif untuk mengetahui permasalahan regulasi dan implementasi kewenangan pengelolaaan wilayah laut Wakatobi. Penelitian ini diorientasikan untuk memecahkan permasalahan tumpang tindih kewenangan dengan menggunakan perspektif regulasi, dengan tujuan untuk mengetahui tumpang tindih kewenangan, potensi konflik pengelolaan, hierarki hukum serta arahan kewenangan dan kelembagaan dalam pengelolaan Taman Nasional Wakatobi. Teknik analisis yang digunakan adalah membuat simplifikasi terhadap kedudukan hukum dari berbagai regulasi yang terkait dengan pengelolaan Taman Nasional Wakatobi dengan menggunakan skoring berdasarkan asas preferensi hukum yang ada. Hasil penelitian ini menunjukkan bahwa sesungguhnya tidak terjadi tumpang tindih regulasi dalam pengelolaan wilayah Taman Nasional Wakatobi, yang dibutuhkan adalah kepastian dan tindak lanjut proses pengalihan kewenangan berdasarkan Undang-Undang Republik Indonesia Nomor 1 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 27 Tahun 2007 Tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil. Kata kunci: Kewenangan, wilayah laut, Taman Nasional Wakatobi, regulasi ABSTRACTThis study uses a qualitative approach to determine the problems of regulation and implementation of authority of Wakatobi marine area management. This research is oriented to solve the problem of overlapping authority by using a regulatory perspective, with the aim to knowing the overlapping of authority, potential management conflicts, legal hierarchy and authority and institutional directives in the management of Wakatobi National Park. The analytical technique used is to simplify the legal status of various regulations related to the management of Wakatobi National Park by using scoring based on the principle of existing legal preference. The results of this study indicate that there is no overlapping regulation in the management of Wakatobi National Park area, which is needed is the certainty and follow-up process of transfer of authority based on the Law of the Republic of Indonesia Number 1 Year 2014 About Amendment of Law Number 27 Year 2007 About Management Coastal Areas and Small Islands..Keywords: Authority, marine area, Wakatobi National Park, regulation
